SOFTWARE LICENSE AGREEMENT FOR THE NI HAO LANGUAGE LAB

Please Read This Software License Agreement ("License") Carefully Before Downloading The Chinasoft Software. By Downloading The Chinasoft Software, You Are Agreeing To Be Bound By The Terms Of This License. If You Do Not Agree To The Terms Of This License, Click "Disagree".

1. GRANT OF LICENCE. With the purchase of the Ni Hao textbook to which this software refers and with your agreement to abide by the terms and conditions of this licence, ChinaSoft, as licensor, grants you, the LICENSEE, a non-exclusive right to use and display this copy of this SOFTWARE on ONE COMPUTER owned or leased by you for either the Macintosh or Windows platforms.

2. OWNERSHIP OF SOFTWARE. ChinaSoft retains title and ownership of the Software as well as all subsequent copies of the software, regardless of the form or media in or on which the original and other copies may exist.

3. CONTENT. All images and sound (collectively “Content”) contained in this software is owned by ChinaSoft. You may not copy, sell, license, or otherwise distribute any content.

4. COPY RESTRICTIONS. This software and accompanying materials are subject to copyright. Unauthorised copying of the software, including software which has been modified, merged or included with other software or of the written materials is expressly forbidden. You may be held legally responsible for any copyright infringement which is caused or encouraged by your failure to abide by the terms of this Licence.

5. SINGLE USE. This License allows you to install, use and run one (1) copy of the ChinaSoft Software on a single computer at a time. You agree not to install, use or run the ChinaSoft Software on any other computer, or to enable others to do so. This License does not allow the ChinaSoft Software to exist on more than one computer at a time, and you may not make the ChinaSoft Software available over a network where it could be used by multiple computers at the same time.

6. TERMINATION. This License is effective until terminated. Your rights under this License will terminate automatically without notice from ChinaSoft if you fail to comply with any term(s) of this License. Upon the termination of this License, you shall cease all use of the ChinaSoft Software and destroy all copies, full or partial, of the ChinaSoft Software.

7. DISCLAIMER OF WARRANTIES. In no event will ChinaSoft, its staff, principals or agents, be liable to you for any damages, including lost savings or other incidental or consequential damages arising out of the use or inability to use this software, or for any claim by any other party. The entire risk as to the results and performance of this software is assumed by you.
